Death penalty: A good example to protest serious crime Kumara Islam ID: Abstract In recent times, Death Penalty has increased in our country. Government has established this rules regarding death penalty in order to control the crimes that has gone out of hand. Capital punishment plays significant, non-emotional role in Bengali social and political culture. I suggest that the death penalty becomes an unproblematic, indeed, preferred method and symbol of Justice in this venue through a discursive process which reduces the underlying social issues to a battle between average citizens and evil murderers.
Once so reduced, no costs of capital punishment can outweigh the Justice of it. Ultimately these communications reveal a set of sensibilities about crime and punishment which seem to long for a detour from the civilizing path, in that the communicators seek to deny any interdependencies or empathic with those who commit violent crime, while working to unleash punishment from its institutional restraints. The facts of death penalty: There are some facts about death penalty in our society. Some of the facts with the actual representation of the social perspective are given below: MYTH #1: Innocent people are not executed Professionals in the Jail know that innocent prisoners have been executed. Over of death row prisoners in the Bangladesh may be innocent.
MYTH #2: The death penalty reduces crime The death penalty does not deter crime. It stimulates criminal activity, by brutalizing the population. MYTH #3: The death penalty saves money The death penalty costs tax-payers millions more dollars than a sentence of life without parole. This money could be used more effectively on crime-prevention programs or police. MYTH #4: Only evil people are executed There is a lot more to a human being than his worst action. MYTH #5: Death penalty trials are a fair process People are executed around the world every day because they were denied a fair trial.
MYTH #6: The death penalty applies to everyone equally People accused of the same crime receive vastly different penalties, not only across the world, but also within the same country, and even within the same case. MYTH #7: Executions are humane Nowhere in the world is there a decent way to kill. Hanging, stoning, beheading, MYTH #8: Executions help victims’ families to heal Most families of victims do not feel ‘healed’ by an execution. MYTH #9: The Bible supports the death penalty People have argued for centuries over whether the Bible sanctions the death penalty. But if Jesus were sitting in a courtroom, would he instruct the Jury to order a death sentence? MYTH #10: The death penalty is not political The death penalty is often driven by politics rather than by a desire to fix social or justice issues. So here the researcher wanted to express the fact that the Society is not aware about most of the actual facts regarding death penalty; they Just get to know that a criminal is going to be hanged and this is all they are required for their mental peace. . Why is this analysis appropriate? I) Under the existing protocol, Bangladesh courts submit to the capital case review procedure only cases in which an offense is being charged for which the death penalty is a legally authorized sanction. This limited information cannot Justify someone’s death. So the scope has to be broadened so that the citizens can also understand the facts and to know more about the inside facts. The Department has concluded that information of this type should regularly be available.
This should help to maintain public confidence in the system by making more complete racial and ethnic data available for both actual and potential federal capital cases. The amendment to the protocol will specifically require that, where a Bangladesh Court has obtained an indictment charging a capital offense or conduct that could be charged as a capital offense, the Bangladesh Court must fill out and submit a death anally evaluation form, even if the Bangladesh Court does not intend to request authorization to seek the death penalty.
These forms will include (among other information) gender, race, and ethnicity information for defendants and victims, the charges against the defendant, and the reasons the Bangladesh Court decided not to seek the death penalty or charge a capital offense. I’) The revised protocol will maintain a uniform requirement that the approval of the Attorney General be obtained both for decisions to seek a capital sentence and for sections not to seek a capital sentence.
The Bangladesh Courts will be required to submit information concerning cases involving capital charges, regardless of their recommendations concerning the sentence. However, an expedited and simplified decisional process – not requiring the participation of defense counsel – will be authorized in cases in which the Bangladesh Attorney does not wish to seek a capital sentence. The full-dress review process will be reserved for cases in which: (1) the accept the Bangladesh Court’s recommendation against seeking the death penalty n the basis of the abbreviated review process. Basically for these reasons the researcher has chosen this topic.
According to Model Penal Code (which does not specifically define the crime of capital murder), the Texas Penal Code specifically defines capital murder (and, thus, the possibility of the death penalty as a punishment) as murder which involves one or more of the elements listed below: * Murder of an on-duty public safety officer or firefighter (the defendant must have known that the victim was such) * Intentional murder in the course of committing or attempting to commit a felony offense (such as burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terrorist threat) * Murder for remuneration or for promise of remuneration (both the person who does the actual murder and the person who hired them can be charged with capital murder) * Murder while escaping or attempting to escape a penal institution
