CHAPTER ONE INTRODUCTION 1. 1BACKGROUND OF STUDY In a nation there are some fundamental elements that demonstrate the true existence of certain rights in such a society and these go a long way in showing that it is truly developed in every sense of the word. The level of a nation’s “maturity” depends on how well it fulfils these elements, one of which is Freedom of information. A government ought to be accountable to its people. Freedom of information has two sides namely, the freedom to convey information, and the freedom to access information.

As such, it consists of press freedom and freedom to access any information by the general public. According to Hughes “the concept of freedom refers to a certain type of political empowerment. It refers specifically to equal empowerment. In other words, a free society is one with an equal distribution of legal rights and in which each and every person has as much legal rights as possible ” (Hughes. , 2007). And the Oxford dictionary goes on to say define information as “Knowledge communicated concerning some particular fact, subject or event; that of which one is apprised or told; intelligence, news”.

Freedom of information simply put, gives you the right to ask any public body for all the information they have on any subject you choose (“Freedom of information,” 2001). Having listened to so much talk about “freedom of information” it is indeed pertinent to carefully and deliberately look into the likely objects of the government at different stages or rather eras of press freedom in Nigeria and express likely views on the issue.

The study will also outline importance of freedom of information, consequences and eventual support for or disapproval of freedom of information in the society, making comparisons of this in both military and civilian regimes from Nigeria’s independence till date. This will be the rationale of this study. According to article 19 of the universal human rights, every person has the right to freedom of opinion and expression, to hold opinions without interference and to convey or access information through any media. This study seeks to investigate the practice of this in Nigeria, at different points in time. . 2OBJECTIVES OF STUDY The major objectives of this research as previously mentioned in the background of study are: 1. To outline the freedom of information at different stages in Nigeria – the past, the present and the future of freedom of information going forward. 2. To look at the metamorphosis of freedom of information in Nigeria from its independence in 1960 till date. 3. To research and discuss the likely developments to be expected in this regard as well as where we are with freedom of information and bills being worked on. 4.

To tender likely solutions to the problems and limitations of Freedom of information in Nigeria. 1. 3 PURPOSE OF THE STUDY: The study is focused on exploring the how freedom to convey, air and publish views or information affected us in the past, and how it has affected our growth as a nation. It also seeks to pin point the state of things with regards to the research topic, as well as prospects for the future. 1. 4 RESEARCH QUESTIONS The research will answer the following questions: •What was the state of freedom of information in the country during the early stages of our independence? What was the state of freedom of information in the military era? •What was the implication of the level of freedom of information on the nation during that era? •What has been the state of freedom of information during the civilian era? •How has the state of freedom of information affected the growth of Nigeria as a nation? •What is the current state of freedom of information in the country? •What are the prospects and solutions to problems with freedom of information? 1. 5SCOPE OF STUDY

The study will examine freedom of information under press freedom and freedom of access to information by the public. It will examine this under such eras as, the military and civilian eras and will weigh the progress made over time, as well as make comparisons of both periods. The study will also outline the steps taken for or against the freedom of information with regards to press freedom and accessibility to information by the different administrations. It will examine the ways in which the government has affected freedom of information and how this has affected or will affect our growth as a nation. . 6RESEARCH METHODOLOGY This research will make use of both primary and secondary sources of information. The primary sources to be used will include the 1999 Constitution of the Federal Republic of Nigeria, statute books, law reports, journals as well as other relevant materials, pertaining to freedom of information. The secondary sources to be used are texts and other online materials written within and outside the country, dictionaries and other materials that will aid in answering the research questions. . 7LITERATURE REVIEW The literature to be reviewed includes a number of journals, texts, as well as scholarly articles which are relevant to the study. The study seeks to develop on previous works by different authors and scholars. 1. 8CONCLUSION The study should conclusively after considering the pros and cons as well as development and implications of freedom of information fall in tune with the agitation of freedom of information or agree that indeed a limit should be rested on.

How Freedom of Religion Cultivates American Innovation In the annals of American history, religion takes up volumes. The framers used Judeo-Christian values as a cornerstone to create democracy in the nation. Manifest Destiny, a concept coined by William Jennings Bryan, explains that it was the people’s God-given right to populate the continent and reign from the east to west coast. Before the Civil War, among thousands of individuals, preachers and followers of the protestant faith were the largest faction in America to assist slaves in escaping plantations (Ogden, 61).

So why did the Founding Fathers not limit the exercise of other religions in their writing of the Constitution? For the same reason most religions hold their faiths as truth. Individuals find security in religion and religion shapes who they become. Hundreds of cultures throughout the world leave everything including their health up to the God who manages them. Others believe in consulting a higher power in order to attain individual success. It is important that the state not cross the lines of religious freedom unless religious expression harms the rights of others – in the case of polygamy or human sacrifice.

The framers knew that if they created a country that favored Christianity, personal beliefs of those outside that religion would be devalued and a follower might not feel safe as a citizen of his own nation. The framers allowed religion in the Bill of Rights to inspire every individual to pursue themselves and become the realization of their thoughts and beliefs. America’s reputation grew from religious freedom. When the founding fathers came up with a document stating the rights of an American, they hoped they wouldn’t be the only ones to create a new idea.

Therefore they allowed room for individual expression. An individual should create his idea of himself and that drive came to most people through religion. Religious freedom guided the Puritans to develop the first university in America, Harvard. It was founded by ministers who realized the need for a clergy in a growing population. It became the nucleus of theological teaching in New England by 1827 and gave America its first philosopher John Calvin, the creator of Calvinism and harbinger of the First Great Awakening. Today, Harvard is in the ranks of the highest achieving universities in the world.

Although it started out as a seminary with nine graduates, today Harvard’s 360,000 living alumni p 190 countries. Religious freedom allowed the Protestants to lead their country to greatness. The First Amendment is not only expressed through education. American businesses also practice certain religious aspects. Famous restaurants one would not suspect exercise the power to practice Christianity. In-N-Out Burger, a popular Western fast food franchise will inconspicuously print Bible verses on cups per customer request.

Wendy’s owner Dave Thomas was quoted, saying, “You can be anything you want to be within the law of God and Man”. His success demonstrates how prosperous a Christian owned business can be when coupled with strong beliefs. Finally, Quaker Cadbury Adams from Parsippany, New Jersey established “Cadbury”, the 2nd largest producer of chocolate and drinks in the world. It purports a net income of $700 million a year (Forbes 2012). Clearly, business in America has benefited from diversity. However, it is important that Americans keep religious freedom in perspective.

Religious freedom should not influence two entities to battle between the validity of their party’s beliefs. Darwin’s Theory of Evolution and Galileo’s heliocentric model of the universe are two examples in which Christianity has been tested. In the 1600’s, Catholics believed Galileo’s ideas were blasphemy. His theory that earth was not the only planet, much less the center of the universe, rocked the Church’s platform. Because he did not live in a democratic nation, his government put him under house arrest, all but silencing his discovery.

However, Galileo’s theory was in fact only an explanation of the natural world. Although science and religion serve two different purposes, the Church took Galileo’s observation on nature as an attack on Christianity and locked him up. Today, Americans view the Church’s treatment as unjustified. Four hundred years and successful flights to the moon later, it is difficult to argue that the Church was correct in its attack on Galileo. From the perspective of a country with the First Amendment right, it seems unimaginable. However, today’s churches now test religious freedom.

Under the protection of the Bill of Rights, Evangelical Christian D. James Kennedy has prosecuted Darwin’s Theory of Evolution. He believes evolution is, “a dangerous opinion that deems God’s judgment on Earth” (Kennedy 183) and has many dogmatic followers. He believes public schools should not teach evolution because it conflicts with Creationism. However, by law action taken on Kenney’s part infringes on the rights of others. His Christian agenda supersedes the beliefs of other faiths, such as Hinduism, Islamism, or Judaism, which contradicts freedom of expression.

If Darwinism was kept from being taught in public schools, the government would be ignoring the rights of other faiths. Darwinism is taught in school is because his views are seen as science. Science deals with natural explanations about the world (Coriden 12). If science were to have a metaphysical stance involving supernatural explanations for the universe, it would cease to be a worthwhile pursuit. The explanation for a question would become too simple and deferred to God or another supernatural being. That understood, science is unable to disprove religion by fact and religion cannot disprove science by belief.

A connection between the two would seem to be a non sequitur. Truly, neither harms the other. In fact, the opposite may be endorsed. The more discoveries science makes, the more difficult it makes man’s purpose to explain. People will turn to religion for comfort because usually a combination of the natural and supernatural will mold an individual’s sense of reality. Thankfully, America is a country where one can chose how much to believe in the natural and supernatural. The First Amendment puts no belief system ahead of another.

The Founding Fathers believed in order to avoid religious persecution, that they must create a nation open to every ideology. As they intended, the United States flourished under the principles of equality. Today, the United States Constitution is used as reference for countries constructing a democratic nation because of the success and freedom Americans enjoy. Although the democratic system is not flawless, it opens the road to individual achievement that does not exist in all countries by allowing religious freedom and the freedom of expression.

Freedom of expression is the concept of being able to transfer ideas or thoughts verbally or otherwise freely without censorship. It was awarded global recognition as a universal human right and ingrained in the Article 19 of the Universal Declaration of Human Rights. In spite of its status, it is never absolute in any country. Like a spectrum of colours in rainbow, the society displays the wealthy and poor in ranks of dignity; regimes with rotten ideologies, people with divisive utterances and societies with despised wisdom. Freedom of mass media is the fundamental basis on which democracy and good governance are pivoted. Advantages of free press is the reason for the revolution in information that forms the global village (globalisation).

As history notes, Sukarno, the former President of Indonesia, during a visit to Hollywood characterised media as unconscious revolutionaries because media-makers create new expectations, increase knowledge of other possibilities of better life for example, of other ideologies, and even other forms of governances. And as very often been stated, it remains true, what the eminent Thomas Jefferson, one time American President had to say once, and I quote: Were it left for me to decide whether we should have a government without newspapers, or newspapers without a government, I should not hesitate a moment to prefer the latter ……” Tacitly put by Dr. Outa, Research and Communications Advisor, “our safety is perhaps unconceivable today without a vigilant and questioning press that reminds us constantly of our shortcomings” Indeed it is a truism that in the modern world, the press is the primary source of quick and actionable pieces of information, without which our citizens and their leaders at large would remain, fatally ignorant!

The question of media regulation stems from the fact that media are social institutions and equally, they are industries operation in society. Without the due diligence to these fundamental principles of fairness, accuracy, the very defence of press freedom collapses and thereby opening the unsavoury gates of acrimony and misunderstanding with a whole range of stakeholders. For example, Gerbner (1969) argues that mass communicators operate under pressure, including for example advertisers, competitors, authority (legal/political structures), other institutions and the audience. To the extent that media are part and parcel of society, a measure of control is required. Media control is difficult because of the unique place media occupies in society.

For example: i) they produce goods and services which are both private and public in nature. Public service in that the info is necessary for the working of society; private because there is personal gratification, ii) Media have unique characteristics because they perform a political function whereby free press is an important element of democracy. In that case, there should be no monopoly of information by any one quarter. Media occupy that important perch because, historically, what media do or do not do has mattered in society and public life. Media, if not a public property, is in the public domain.

Since media operate in society and are related in some ways to the prevailing societal structures viz: politics, economics, culture it is only fair that it be controlled by the some structures. This is so because media are able to: attract and direct attention; mould public opinion; influence behaviour and confer status; and confer dominant definitions in society—who is to be listened to; who is to be followed, etc. Media regulations and control in any given society depend on the prevailing media environments, which differ from one place to another, one time to another, one period to another, one culture to another.

Although the importance of press freedom cannot be denied, it is generally asserted that media can promote visions of common purpose and at the same time can promote visions of discord and disunity. Although it is accepted that objectivity should be the guiding spirit, instances of press partisanship have been common place globally—sensationalism, owner interference, pursuit of profits, self-interest, etc. Every State has a political interest in controlling the activities of the media within its boundaries. This interest is a legitimate one based on the idea of sovereignty.

Yet when we accept that sovereignty is supreme, the following questions become important:

  • Who defines the role of the media?
  • How much control should the State exercise?
  • What acceptable methods and instrument of control should the State adopt?

These questions lack easy answers. In spite of all, mass communicators agree that self regulation is a perfect way of media being on track yet the Swahili proverb of Kinyozi hajinyowi (barber cannot shave himself) creates a dilemma of state/authoritative interventions.

The New Ideology of Manifest Destiny and Freedom

The 1950s were a time of revitalization. They were a time of rebirth for the American people. World War II had ended and heralded the reinsertion and reintegration of thousands of service members into society. Working women who epitomized Rosie the Riveter and passed into the workforce along with their 12 million counterparts working when the US entered the war, saved the money they earned. Prior to the end of the war, there was not much to spend earned income on with the exception of war bonds. Afterwards, however, American industry expanded like never before.

The buying power offered to Americans expanded, as well. Goods that were not available during the war became readily accessible. This increased the job market and stimulated the economy. Not only that, but the returning soldiers helped the US experience a population boom helping to facilitate a spike in consumerism. Veterans were starting families and were in need of housing which the Levitt family began and perfected, building housing areas called Levitt-towns. People were increasingly more materialistic—shopping for wants and not just needs. It was truly the Fabulous Fifties.

Out of this time was born a generation of seeming radicals that fought against the agreed upon normalcy of the times. This ‘Beat Generation’ reimagined the ideals of Manifest Destiny and freedom because they wanted to be free to explore what was considered insanity by many but for them was artistic expression—a breaking free of conformist beliefs of the supposed American dream of materialism and gain. The Beat Generation or Beats, as they were sometimes called was a term coined by the author and member of this same generation Jack Kerouac during a conversation with fellow writer, John Clellon Holmes.

He clarified his phrase by saying beat “meant being socially marginalized and exhausted—‘beaten down’—and blessed—‘beatific’ ” (“Mid-1950s-1960s”, 2007). The term implied their generation was beaten down for their artistic nature and general deviance from mainstream behavior. Beatniks were labeled law breakers, troublemakers and rebel rousers and charged with being communists. In fact, in 1961 the director of the FBI, J. Edgar Hoover claimed that the beatnik lifestyle was in the top three major threats to American society and way of life. Kerouac and other founders of the generation took offense to this accusation.

Their insistence was they merely wanted to be free to explore what may have been considered absurdity but really were searching for what they felt was missing in life. They were searching for a deeper meaning. They refused to be complacent just because the war had ended and the world was seemingly a better place. Things were not perfect just because the economy was on the rise. The war had not solved humanity’s problems and consumerism was just an empty shell for them. Therefore, this search for a higher self, took the form of experimentation.

Many of the Beats were openly homosexual or bisexual and freely experimented with their sexual natures. They aligned themselves with the culture of jazz musicians and the music they made. Jazz music followed no preordained rules. There were no wrong notes no matter how raw. The more noisy and discordant, the better and more real—emotional—it sounded. The Beats raged in their literature and poetry, sounding much like discordant peals of music echoing from the saxophone of a jazz musician, against those who would suppress them. These feelings were elegantly detailed in the semi-mad ravings of Allen Ginsberg’s poem Howl.

Like Ginsberg, many wrote under the influence of drugs like Benzedrine and marijuana, experimenting with them in order to achieve a state of transcendentalism. Gregory Stephenson (2009) explains it thusly, “The poet, for a visionary instant, transcends the realm of the actual into the realm of the ideal, and then, unable to sustain the vision, returns to the realm of the actual. Afterwards the poet feels exiled from the eternal, the numinous, [and] the super conscious. The material world, the realm of the actual, seems empty and desolate. The desolation the Beats felt was born from the feeling of being out of sorts and disconnected with a world no longer theirs. This made them howl. They howled, they cried out, they wailed and fought against a forced subjugation. And thus, refusing to be subjugated, they were ostracized. Thereby, making them howl more and inspiring the title of Ginsberg’s poem. In analyzing the poem, it is clear Ginsberg wanted to accomplish two things. First, he wanted to exact an unmistakable and distinct delineation between those who fall under the Beatnik category and those they feel are the conformists of their time.

Secondly, he made it known that this was their declaration, it was their manifesto of freedom. “I saw the best minds of my generation destroyed by madness, starving hysterical naked, dragging themselves through the negro streets at dawn looking for an angry fix, angel headed hipsters burning for the ancient heavenly connection to the starry dynamo in the machinery of nigh, who poverty and tatters and hollow-eyes and high sat up smoking in the supernatural darkness of cold-water flats floating across the tops of cities contemplating jazz…” (1955).

The material world Stephenson speaks of and the fix Ginsberg speaks of correlates to the Beats movement centered on a lifestyle of a total rejection of this mainstream idea that one and one must always equal two, one must always know when the right time is to settle down, what constitutes a productive member of society, a person must write and speak in formalities, have a certain religion, wear what is acceptable and love who is acceptable in order to be accepted into society. They used alcohol and drugs to feel and then proceeded to write down what they felt, even if it was not in a formal order that made sense.

Therefore, “the academic community derided the Beats as anti-intellectual and unrefined…Established poets and novelists looked down upon the freewheeling abandon of Beat literature” (“The Beat Generation”, 2013). Furthermore, this ‘freewheeling abandon’ applied to more than just the literature of the Beat movement, it applied to their psychical bodies, as well. American history was based on an idea of expansion, evidenced by a phrase coined in 1845 by editor, John O’Sullivan, called “Manifest Destiny”.

Those that settled in the newly founded America believed “courageous pioneers…had a divine obligation to stretch the boundaries of their noble republic…” (“Manifest Destiny”, 2013). And yet in the 1950s these ideals America was founded on came to a screeching halt despite the mass production and affordability of automobiles and the interconnectedness of cities by highways. People became complacent and began to settle down in Post-World War II newly built homes in newly generated housing areas. The word of that era was conformity.

The houses were all built to a certain style; the yards were groomed in the same way; the people behaved in a manner as what was expected of them. The idea of buying a home and being stationary represented a large section of what the Beat Generation saw as conforming to a capitalist and consumer-based lifestyle. The Beats advocated a hobo type of lifestyle, rather than one weighed down by physical possessions. “These men…were attempting to escape what were perceived as the restrictive shackles of the nuclear family but…rejected the trappings of a settled bourgeois lifestyle and were geographically mobile” (McDowell, 1996).

So the romanticism surrounding Jack Kerouac’s autobiographical book On the Road, which spoke to those in this generation and wanting to relate or understand them, also became the definition of the ideology of the Beat Generation. An ideology which said ‘Life should be actively lived and you must make of it what you want, not what others tell you to want to make out of it’. It was about “…grabbing and doing it. It was about not wanting to stay somewhere and rooting, but rather going somewhere and making your own reality” (“American Road”, 2011).

Kerouac epitomized this in his book: “…I left with my canvas bag in which a few fundamental things were packed and took off for the Pacific Ocean with the fifty dollars in my pocket. I’d been poring over maps of the United States in Paterson for months, even reading books about the pioneers and savoring names like Platte and Cimarron and so on, and the road-map was one long red line called Route 6…I’ll just stay on 6…I said to myself and confidently started…Filled with dreams of what I’d do in Chicago, in Denver, and then finally in San Fran,…I started hitching up the thing” (Kerouac, 1957).

He wondered and daydreamed about what he would do in those cities, but knew what he did not want to do. Kerouac’s character, Sal, did not want to miss out on anything by becoming deadened, which is silently implied, had he joined the rat race and gotten a job. It was wasted energy. He “hated the thought of it…There were so many other interesting things to do [and meet]” (Kerouac, 1957). The ideals incarnate in his book through his characters were an open and honest free love of people, an enjoyment of the experiences that were happening in the now, and a meeting of the minds of ll types and races of people. They were colorblind. And this was also new in a time when people who were different were excluded or called communists. In a time when Joseph McCarthy was initiating a ‘Red Scare’ and accusing citizens of being communists and Hoover’s G-Men were illegally wire-tapping politicians and regular citizens alike, people had become overly suspicious of everyone. People were anxious to show militarism and an acquiescence to conform to what was inherently American. Yet, in spite of this, Beatniks marched to their own poetry and beliefs.

Ginsberg howled and Kerouac left on a holy trek to find a true inner consciousness, laden with real freedom and genuine spontaneity. Several times, Sal’s character considered traveling elsewhere instead of his intended destination for no other reason than to see where the roads would take him or what or who would lie in that particular direction. Though most, if not all, those in this beat generation originally came from a middle class background, they rejected it as being conformists and closed minded. “Conformity [to them] was born from fear of the political system” (“American Road”, 2011).

They were not afraid though they felt this overt obsession with conforming to an evil government and material possessions was killing the spirit and creativity found within. This idea was further cemented by Ginsberg statement of the best minds of his generation being destroyed. In the second part of Howl, Ginsberg continually mentions the name or entity “Moloch” and in the context he uses it, one can ascribe a negative connotation to it: “What sphinx of cement and aluminum bashed open their skulls and ate up their brains and imagination? Moloch! Solitude! Filth! Ugliness! Ashcans and unobtainable dollars…Moloch the heavy judger of men! Moloch the incomprehensible prison! Moloch the crossbone soulless jailhouse and Congress of sorrows! Moloch whose buildings are judgment! Moloch the cast stone of war! Moloch the stunned governments” (Ginsberg, 1957)! This entity “Moloch” no doubt represents all the things in American society considered to be the norm, but for the Beat Generation is stifling and oppressive.

Cement and aluminum were the utensils builders used to build homes like Levitt-towns and universities that inhibited free thinking and self-expression. He mentions unobtainable dollars because the pursuit of money and material possessions was a fleeting happiness. Once possessed, it is no longer desired. And everywhere they turned there was heavy judgment, except from their own kind. The publishing and almost instant success of Jack Kerouac’s book, On the Road, as well as the publishing of other Beat writers, like Allen Ginsberg, marked the beginnings of an evolutionary change.

The Beat Generation became a subculture that truly impacted America. Men and women—teenagers and young adults, were finding themselves increasingly disillusioned by a lifestyle that was centered on home and work. People were taking a page from Kerouac’s life and hitting the road on a journey to find themselves and what meaning life really had for them. They were taking verses from Ginsberg’s manifesto and “…bit[ing] detectives in the neck and shrieked with delight in policecars for committing no crime but their own wild cooking pederasty and intoxication… (1957). Indeed, the Fabulous 50s brought with it trials and tribulations, materialism and consumerism, and in general, the earmarks of an American social way of being that is still prevalent today. But within that culture, a counterculture was also born whose inhabitants were not satisfied with the world as it was. They were not satisfied with what the world wanted to turn them into. They wanted to march to the beat of their own drum; to experience what was out there in the world and truly be liberated.

Born of this desire was the Beat Generation, the forebears of the hippies of the 1960s. They advocated a freedom and liberation of minds and bodies. They wanted to be liberated of all censor. They wanted the freedom to love hard and fast, to travel at will and forsake the idea that in order to be truly happy one had to engage in a rat race of empty labor for money and material possessions. The Beatniks reinforced and reimagined the ideals of Manifest Destiny and chose to manifest their destiny of finding the freedom to be themselves and love it despite opposition.
